TERMS OF USE FOR NYC LUXURY TRANSPORT LLC

PLEASE READ THESE TERMS OF USE CAREFULLY. BY USING OUR SERVICE, YOU SIGNIFY YOUR ACCEPTANCE OF THESE TERMS. IF YOU DO NOT AGREE WITH ANY OF THE TERMS BELOW, PLEASE DO NOT USE OUR SERVICE. NYC LUXURY TRANSPORT LLC RESERVES THE RIGHT TO MODIFY, ALTER, OR UPDATE THESE TERMS OF USE AT ANY TIME. BY CONTINUING TO USE OUR SERVICE, YOU AGREE TO BE BOUND BY SUCH MODIFICATIONS, ALTERATIONS, OR UPDATES.

1. Reservations

We encourage our clients to reserve a vehicle in advance (at no additional charge) to ensure availability at the desired time of pick-up. Reservations can be made on short notice by phone or online, subject to availability. Once a reservation is confirmed and processed by one of our representatives, there will be NO Refunds. If a customer wishes to cancel, they must do so at least 24 hours prior to the scheduled pick-up time to receive a credit toward a future reservation.

Upon the driver’s arrival, the customer MUST provide a valid government-issued identification card and/or the original payment method used to make the reservation to prevent fraud.

2. No-Shows

If you do not see your driver at the designated pick-up point, do not leave without contacting our dispatch office at (631) 948-6315. We will direct you to your chauffeur. If you leave without calling, you will be billed for the full price of the ride (or a no-show fee). Our drivers will wait up to 30 minutes for regular pick-ups and up to 60 minutes for airport pick-ups after the scheduled pick-up time. If we are unable to reach you after this period, the driver will be released, and you will be billed for a “No-Show,” which equals the full price of the ride plus any waiting time charges. To authorize additional wait time, please contact the office. Failure to do so will result in billing for the ride and applicable waiting time charges.

3. Diverted and Canceled Flights

NYC Luxury Transport LLC will monitor flights until the vehicle is dispatched. If a flight is delayed after dispatch, additional wait charges may apply. If a flight is diverted, a “No-Show” fee may be charged or additional wait time if authorized by you for the driver to wait until the new arrival time.

4. Damages Resulting From Your Actions

If any damage occurs to the vehicle due to the actions of you or your authorized party, you agree to cover the costs of cleaning and repairing the vehicle. If the vehicle is rendered out of service due to such damage, you will be responsible for compensating NYC Luxury Transport LLC for lost revenue until the vehicle is back in service.

5. Alcohol Consumption

Alcohol consumption is permitted only in vehicles with a divider (limousines). Alcohol is prohibited in standard vehicles without a partition between passengers and the driver.

6. Food and Drinks

No open container foods are allowed in NYC Luxury Transport LLC vehicles. Only bottled drinks are permitted.

7. Credit Card Transactions

To guarantee funds availability, we take an authorization for the full amount on the card 48-72 hours prior to the scheduled ride. This may appear as “pending” or “posted” on your credit card statement. The authorization amount may exceed the expected charges if you decide to make additional stops or change your destination. Final charges will be processed after the trip is completed. All receipts are sent by email. We utilize secure 128-bit SSL encrypted payment processing. By submitting payment details, you consent to the detection and storage of your IP address to help prevent credit card fraud.

8. Disputes

  • Corporate Clients: All charges on the invoice will be considered correct and due upon receipt unless we receive an objection within 10 days from the invoice date. Disputes should be emailed to info@nyluxurylimos.com with copies of vouchers and details of the disputed charges. Disputes raised after this period will be considered final and non-refundable.
  • Individual Accounts: All charges applied to a customer’s credit card will be considered correct unless we receive an objection within 15 days from the charge date. Disputes raised after this period will be considered final and non-refundable.

9. Collection Fees

You agree to pay all fees, including legal, litigation, accounting, and other costs associated with collecting payments due in cases of non-payment.

10. Rates Changes

NYC Luxury Transport LLC reserves the right to change rates and any associated fees, costs, or charges at any time without prior notice.

11. Pricing Errors and Glitches

We make every effort to provide accurate pricing information. However, if a product is listed at an incorrect price, NYC Luxury Transport LLC reserves the right to refuse or cancel any orders placed for products listed at the incorrect price.

12. Itemized Invoices

  • Corporate Clients: Itemized invoices will be sent as “Due upon receipt” at the end of each month.
  • Individual Accounts: Itemized invoices are available upon request.

13. Payment Due Date

  • Corporate Clients: Payments must be received within 15 days from the invoice date unless otherwise specified in the contract. Late payments will incur an interest charge of 30% per year or 2.5% per month.
  • Individual Accounts: Payments must be made before the ride is executed.

14. Point-to-Point Fare

Point-to-Point Service is based on mileage and zones, not a set period. If you require a vehicle for a specific period, please book hourly service.

15. Hourly Rates

Vehicles rented hourly are subject to a minimum rental period of 2 hours. The hourly charge is calculated from the scheduled pick-up time to the drop-off time at the designated area.

16. Waiting Time

For airport pick-ups, a grace period of 30 minutes for domestic flights and 60 minutes for international flights is provided. For all other pick-ups, a 15-minute grace period is allowed. After this period, waiting time charges apply, calculated in 1-minute increments.

Wait Time Rates:
Sedan: $1.10/minute
SUVs: $1.50/minute
Sprinter Vans: $2.50/minute

17. Stops

Each additional stop incurs a $25 fee. Courtesy stops for short durations, such as restroom breaks, do not incur additional charges.

18. Tolls

All tolls are calculated on a round-trip basis and added to the reservation after it is created.

19. Meet & Greet

Meet & Greet Airport Service is available for an additional $25 fee. The driver will meet the passenger at baggage claim or customs exit with a sign displaying the passenger’s last name.

20. Luggage

NYC Luxury Transport LLC is not responsible for damage to luggage or its contents.

21. Parking

Parking fees and other airport regulatory fees are additional charges and are passed directly to the customer.

22. Gratuity

A gratuity is added to every trip. There is no need to tip additional amounts unless desired.

23. Baby Seats

Baby seats are available for an additional fee of $15 per seat. Please mention your need for a baby seat when making a reservation.

24. Service Error

In the event of a vehicle breakdown or service error, NYC Luxury Transport LLC will attempt to provide a replacement vehicle equivalent to the original reservation. We cannot be held liable for missed reservations or appointments due to service errors.
